Probate is a proceeding in which the courts oversee the transfer of assets in an estate to its beneficiaries.  With a few exceptions, assets outside of a trust, even if in a will, must go through probate before distribution to a decedent’s heirs.

If the decedent left a will, the assets are distributed according to its terms.  If the decedent has not left any documents dictating the distribution of his or her estate, assets will be distributed according to the state’s intestate laws.
